Legislative Update: Key Compliance & Risk Considerations

Guidance to Support Member Planning, Readiness, and Risk Awareness

 

This legislative update focuses on California laws effective July 1, 2026 that require affirmative action by school districts and county offices of education.

It is intended to support our Members by identifying key policy, training, facilities, and documentation considerations to help assess readiness and proactively address potential compliance, regulatory, and liability risks.

 

SB 848 – Pupil Safety & Professional Boundaries

Policy trigger: Student safety, professional boundaries, and child abuse prevention responsibilities

Member Actions Required by July 1, 2026 (additional deadlines July 1, 2027):

  • Update mandated reporter policies to reflect expanded coverage, including certain volunteers
  • Adopt and implement written professional boundaries policies
  • Update hiring and employment disclosure procedures
  • Provide child abuse prevention and grooming awareness training to required staff
  • Update Comprehensive School Safety Plans to reflect new statutory requirements

Risk focus: Increased exposure related to employee misconduct, failure to report, and post‑incident scrutiny of hiring practices, training, and safety planning.

 

AB 49 & SB 98 – Immigration Enforcement on School Campuses

Policy trigger: Immigration enforcement activity affecting school campuses

Member Actions Required by March 2026:

  • Adopt written protocols limiting immigration enforcement access to nonpublic campus areas absent a judicial warrant
  • Establish staff response and referral procedures
  • Implement staff training on lawful access and response requirements
  • Develop family notification procedures consistent with state law
  • Update school safety and emergency plans accordingly

Risk focus: Student and family safety concerns, civil rights compliance, and heightened scrutiny of staff responses during enforcement actions.

 

AB 727 – Suicide Prevention Information on Student ID Cards

Policy trigger: Student suicide prevention and crisis awareness

Member Actions Required by July 1, 2026:

  • Update middle school and high school student ID card designs
  • Include the 988 Suicide & Crisis Lifeline
  • Include The Trevor Project suicide prevention hotline
  • Coordinate updates across printing vendors and student information systems

Risk focus: Potential liability and reputational exposure following a student mental health crisis where required prevention resources were not provided.

 

AB 1454 – Evidence‑Based Literacy (“Science of Reading”)

Policy trigger: Reading instruction, professional development, and credentialing standards

Member Actions Required (Phased beginning in 2025):

  • Align TK–5 literacy instruction with evidence‑based reading practices
  • Ensure instructional materials meet updated state requirements
  • Update professional development plans for affected staff
  • Monitor changes to credentialing and training standards
  • Plan for phased implementation timelines and reporting requirements

Risk focus: Instructional compliance, curriculum adoption challenges, and increased oversight tied to student literacy outcomes.

 

AB 715 – Anti‑Discrimination & Antisemitism Prevention

Policy trigger: Discrimination, harassment, and hate‑based incidents on campus

Member Actions Required by January 1, 2026:

  • Coordinate with the new State Office of Civil Rights as appropriate
  • Integrate guidance from the Antisemitism Prevention Coordinator
  • Review and strengthen anti‑discrimination policies and response procedures
  • Ensure staff are informed of reporting, investigation, and response protocols

Risk focus: Civil rights liability, complaint investigations, and reputational harm following hate or discrimination incidents.

 

AB 3216 – Student Smartphone Policies

Policy trigger: Student use of smartphones on campus

Member Actions Required by July 1, 2026:

  • Adopt a local policy limiting or prohibiting student smartphone use on campus
  • Define exceptions, enforcement procedures, and disciplinary responses
  • Communicate policy expectations to students, families, and staff
  • Train staff on consistent implementation

Risk focus: Classroom disruption, inconsistent enforcement, and student discipline challenges.

 

SB 760 – All‑Gender Restrooms

Policy trigger: Student access to restroom facilities

Member Actions Required by July 1, 2026:

  • Ensure at least one all‑gender restroom is available on each campus
  • Identify suitable facilities and complete any necessary modifications
  • Update campus maps and communicate availability to students and staff

Risk focus: Facilities compliance, student access concerns, and potential civil rights claims.

 

AB 495 – Family Preparedness & Caregiver Designations

Policy trigger: Student caregiving arrangements during parental detention or deportation

Member Actions Required by January 1, 2026:

  • Expand caregiver designation options consistent with statute
  • Limit collection and retention of immigration status information
  • Update enrollment, emergency contact, and student records procedures
  • Train staff on privacy and implementation requirements

Risk focus: Student welfare concerns and exposure related to improper information collection or denial of caregiver access.

 

SB 1248 – Extreme Heat & Weather Safety

Policy trigger: Extreme heat, AQI, or other hazardous outdoor conditions

Member Actions Required by July 1, 2026:

  • Adopt and implement written extreme‑weather protocols aligned with CDE guidance
  • Define temperature and AQI thresholds and decision‑making authority
  • Establish monitoring, communication, and indoor‑alternative procedures
  • Train staff on weather‑related distress recognition and response
  • Annually review and update protocols

Risk focus: Potential student injury exposure and heightened review of policies and staff training following an incident.

 

SB 1383 – Organic Waste Recycling & Edible Food Recovery

Policy trigger: Solid waste disposal and food recovery requirements

Member Actions Required (Ongoing; enforcement beginning 2026):

  • Implement mandatory organic waste recycling programs
  • Provide properly labeled landfill, recycling, and organic waste containers
  • Conduct staff and student education on waste separation
  • Monitor contamination and maintain required records
  • For schools with food facilities, donate excess edible food and maintain agreements with food recovery organizations

Risk focus: Regulatory enforcement actions, penalties for noncompliance, and operational oversight of food service practices.
